ECtHR Grand Chamber to hold hearing on Azerbaijani refugees’ cases

The Grand Chamber of the European Court of Human rights will hold a hearing on the cases of Azerbaijani refugees from Nagorno Karabakh, APA reports. They are Azerbaijani nationals Elkhan Chiragov, Adishirin Chiragov, Ramiz Gebrayilov, Akif Hasanof, Fekhreddin Pashayev and Qaraca Gabrayilov. Relying on Article 1 of Protocol No. 1 (protection of property) and Articles 8 (right to respect for private and family life) and 13 (right to an effective remedy) of the European Convention on Human Rights, the applicants complained in particular about the loss of their properties in Lachin and the Armenian authorities have not made attempts to compensate them for their losses or to provide a remedy to persons displaced from the occupied territories. All but Hasanof now live in Baku.

The application was lodged with the European Court of Human Rights on 6 April 2005. On 9 March 2010, the Chamber to which the case was assigned relinquished jurisdiction in favour of the Grand Chamber. The Azerbaijani Government intervened as a third party. A first Grand Chamber hearing in the case was held on 15 September 2010. In a decision of 14 December 2011, the Court declared the complaints admissible. The court also dismissed the Armenian Government’s objection that the application had been submitted out of time.
