Employers recruiting without labor contracts to face 3-year imprisonment in Azerbaijan

“Today, not all employers in Azerbaijan observe the requirements of the labor legislation while signing labor contracts,” said chief of the State Labor Inspectorate Service of the Ministry of Labor and Social Protection of Population Idris Isayev at today’s press conference.

 He said that sometimes employers don’t point out the required items on labor contracts.

 According to him, sometimes the copy of labor contract is not given to the employee. Consequently, the employee is unaware of his or her rights: “Taking advantage of this, an employer takes some steps. According to the amendment made to the Labor Code, the installation of electronic information system at the ministry helps employees to know their obligations and they have right to demand it from employers. Certain amendments have been made to the Code of Administrative Offences in connection with the amendments made to the Labor Code. If certain fines were formerly envisaged for recruitment of any person without labor contract, at present, fines are envisaged for the lack of information about the labor contract on electronic information system. An amendment has also been made to the Criminal Code. According to the amendment, in case of recruitment without labor contract, employers will be fined from AZN 7000 up to AZN 10 000 or sentenced to 3-year imprisonment. Our goal is that all employers in the republic must sign labor contracts with employees and inform them about their obligations.”
