The growth of living standard as a result of successful socio-economic reforms carried out in last years in the Azerbaijan Republic and rapid development of all the economic spheres caused considerable increase of migrant flow into our country and year by year intensifying migration processes.
The necessary standard legal acts were adopted to strengthen state control over migration processes – several institutional and organizational measures were fulfilled, and electronic information data base was created to improve the entry and departure services of foreigners, as well as registration domiciliary.
Besides, as a result of complicated registration procedures, foreigners are obliged to address to different bodies for getting corresponding permission.
To improve the migration control mechanism, granting of corresponding permission for legal residence and labor activity of foreigners and the people without citizenship arriving in the Azerbaijan Republic, simplification of their registration procedure domiciliary and ensuring transparency in this field I enact:
1. To implement “One window” principle in the control of migration processes starting from July 1, 2009.
2. The AR State Migration Service is charged with execution of the authorities of a single state body for the implementation of “One window” principle in the control of migration processes.
3. The AR State Migration Service is charged with the following duties for the implementation of “One window” principle in the control of migration processes:
3.1. To accept documents with the object of granting permission to foreigners and the people without citizenship regarding temporary and permanent residence in the territory of the Azerbaijan Republic;
3.2. To accept documents with the object of granting permission to foreigners and the people without citizenship for paid labor activity in the territory of the Azerbaijan Republic, and hand them over to the AR Ministry of Labor and Social Protection of the Population with its opinion attached;
3.3. To grant permission to foreigners and the people without citizenship for temporary and permanent residence in the territory of the Azerbaijan Republic;
3.4. To register foreigners and the people without citizenship having permission for temporary and permanent residence in the territory of the Azerbaijan Republic domiciliary;
3.5. To give out a corresponding document to foreigners and the people without citizenship having permission for temporary and permanent residence in the territory of the Azerbaijan Republic;
3.6. To extend a residence period of foreigners and the people without citizenship arriving in the Azerbaijan Republic;
3.7. To keep records of foreigners and the people without citizenship living or temporary residing in the Azerbaijan Republic via a single migration information system of the AR State Migration Service;
3.8. To hand over the information concerning permission granted to foreigners and the people without citizenship on temporary and permanent residence in the territory of the Azerbaijan Republic and their registration domiciliary, as well as the information concerning extension of a residence period of foreigners and the people without citizenship arriving in the Azerbaijan Republic to the “Entry-Departure and Registration” Interdepartmental Automatized Data-Search System;
4. The AR Ministry of Labor and Social Protection of the Population is charged with adopting decisions within 7 days on the documents entering from the AR State Migration Service concerning granting or non-granting individual permission for paid labor activity and submitting them to the AR State Migration Service;
5. To define that:
5.1. Application forms regarding granting permission to foreigners and the people without citizenship on permanent residence in the territory of the Azerbaijan Republic are examined by the AR State Migration Service within 20 days;
5.2. Starting from a day of launching “One window” principle in the control of migration processes, foreigners and the people without citizenship, who were granted permission for temporary and permanent residence in the territory of the Azerbaijan Republic, can leave the Azerbaijan Republic or return based on a valid document approving their personalities (a passport or a corresponding document approving the personality of a person without citizenship) and corresponding certificates issued by the AR State Migration Service;
5.3. Registration of foreign diplomatic representations and consulates functioning in the Azerbaijan Republic, the employees of the international organizations’ representations, the people included into the staff of administrative-technical service and members of their family, as well as foreigners arriving with a diplomatic mission in the Azerbaijan Republic or in connection with the cases meant in the international treaties supported by the Azerbaijan Republic are executed by the AR Foreign Ministry;
6. The AR Cabinet of Ministers is charged with the following to be executed within a month:
6.1. To define the quotas of labor migration according to the economic activity taking into account the demands of internal labor market and labor force and inform about it the President of the Azerbaijan Republic;
6.2. To submit to the AR President the proposals regarding cancellation of entry and departure visas granted to foreigners and the people without citizenship;
6.3. To work out the proposals on bringing valid legislative acts into line with this Decree and to submit them to the AR President.
6.4. The AR Cabinet of Ministers and central executive authority bodies should ensure the conformity of standard legal acts with this Decree and inform about it the AR President;
6.5. To settle other issues ensuing from this Decree within its authority;
7. The AR State Migration Service:
7.1. To submit within a month proposals on a draft decision, description and specification of certificates issued to foreigners and the people without citizenship who want to live temporarily or permanently in the Azerbaijan Republic, as well as on the extension of a temporary residence terms of foreigners and the people without citizenship in the Azerbaijan Republic to the AR President;
7.2. To ensure transparency in granting permission to foreigners and the people without citizenship and their registration domiciliary, to carry out explanatory work to inform foreigners and the people without citizenship about new rules, to draw up a memory booklet and take other necessary measures;
7.3. To ensure placing data on the application forms for getting permission, as well as on a list of documents to be submitted and state taxes to be paid in the official web-site of the AR State Migration service;
7.4. To take corresponding measures to get application forms from foreigners and the people without citizenship via e-mail;
8. This Decree should come into force since the day of publication.
